Pre-nuptial and Cohabitation Agreements

These are some of the most important and often overlooked documents in family law. Cohabitation and pre-nuptial agreements are for all couples who want to have a plan for their finances, and are definitely not just for the wealthy.

  • Pre-nuptial Agreements more

This is a contract entered into by husband and wife, prior to marriage, to regulate and protect assets that each has should the marriage break down later. These agreements can now provide significant protection if properly drafted and if all other circumstances are right.

These should be carefully thought through and discussed – ideally you would contact us 2-3 months prior to the marriage to discuss.

  • Cohabitation Agreements more

Despite the rapid increase in the number of couples living together rather than marrying, very few think about the legal issues and it is still very common for people to assume they are protected by “common law” rights.

This is rarely so, and disputes between former cohabitees which reach the courts are often protracted and expensive. A cohabitation agreement is designed to provide evidence to support arguments about intentions (or not) to share.
