For those of us who sometimes watch GMB on ITV, it is impossible to not have heard about the story of Kate Garraway and her husband, Derek Draper, who tested positive for Coronavirus in March last year.He has been extremely poorly in a semi conscious state and has been recognized as one of the longest suffering patients with Covid 19. Indeed Kate herself says that he is the most poorly person the NHS has treated that hasn’t passed away.
She has recently admitted that she is struggling to deal with Derek’s
financial affairs and the more practical side of things. She isn’t able
to access his bank accounts or credit cards, has been unable to remortgage
their house or get mobile phone replacements. This shows how much a
Lasting Power of Attorney is needed when somebody is incapable of dealing with
their own affairs.
A Lasting Power of Attorney is a document which authorizes someone to deal with your affairs if you become incapable for whatever reason. We hope that Derek’s incapacity is temporary but if not, then Kate could have used one for the rest of his life to deal with matters that he can’t.
Because Kate didn’t have a Power of Attorney for Derek, she has had to apply through the Court of Protection to be a Deputy. This is extremely time consuming as the Court of Protection has also suffered delays due to Covid19.
